Lecture 1. CONFLICTING VIEWS OF THE UN HUMAN RIGHTS COMMITTEE AND THE EUROPEAN COURT OF HUMAN RIGHTS CONCERNING THE BAN OF ISLAMIC FULL VEIL IN FRANCE AND BELGIUM

The lecture deal with the practice of the two monitoring bodies on the troubled issue of the full veil bans adopted in France and Belgium, throughout the analysis of the cases brought before them. After a brief introduction on the freedom of religion and belief, the discussion will focus on the the different nature of the supervision exercised by the two supervisory bodies in the light of the principle of subsidiarity and the doctrine of state margin of appreciation as factors influencing the different interpretation of the limits allowed by the Euroean Convention of Human Rights (ECHR) and by the UN Covenant on Civil and Political Rights (UN CCPR).

Lecture 3. THE EUROPEAN PRACTICE CONCERNING THE BANS ON RELIGIOUS SYMBOLS AT WORK IN PRIVATE SPACES

The lectures concentrate on the issue of the bans on religious symbols imposed by private employers based on neutral corporate image policies, in the light of the European Union Charter of fundamental rights and Directive 2000/78 on the one side; and the ECHR on the other side. The different approach and the diverging standards of protection allowed to the religious workers by the EUCourt of Justice and the ECHR will be discussed, with a particular focus on the concepts of direct and indirect discrimination for religious reasons at work.

Prof. Puoti is a member of several Italian academic institutions of international and European law. She has been responsible for the Teaching Module “Jean Monnet” on “Institutional and economic integration in the European Union” and teaches several postgraduate and master's courses. She has also been a speaker and lecturer in many national and international conferences and seminars on international law, international trade and investment law, human rights and European Union law issues. Prof. Puoti has been appointed as expert charged by a national institutional agency manager of an "EU funded Twinning Project" for training courses in Bucharest, Romania. Her academic publications cover various fields of international and European Union law, such as environmental law, State succession, UN collective security system, European Union's Common Foreign and Security Policy, international food safety law, WTO and EU free circulation of goods, freedom of religion, fight against terrorism and data protection, EU fundamental rights, universality of human rights and the protection of diversity and cultural identity.
